This paper´s objective is to point out some of the characteristics of the neoliberal economic globalization and their effects on the State, those effects being favorable to the crisis of the salaried relationship. At the same time, this paper lists some of the negative consequences of the forenamed in the case of the Mexican State and particularly in terms of said State´s functions. It is done by means of a final contemplation regarding the possibilities for Mexico´s institutional reconstruction aimed at facing up to the challenges posed by the breakdown of the social fabric, which is dealt with through the State´s punitive functions that in turn criminalize poverty and misery rather than strengthening the rights of a universal citizenry and thus avoid exclusions.
