The real and practical difficulties that can be seen in the lines of classical and cybernetic legal logic lead to the advisability of focusing on alternative approaches, that is, logical resources linked to non-classical, more flexible logics, among which is the proposal of the weak foundation of Jorge Alfredo Roetti, which I take as the basis of my application proposal to legal logic focused on the analysis of judicial disputes. One of the characteristics that all rhetorical and dialectical activities have is that they are symbolic practices whose end, like that of war and its substitute games, including litigation, is “victory”. And I also propose to apply the concept of “cooperative logic” to the rules of development of a cooperative controversy, which would result in an improvement of the judicial system.
