This article shows the resistances of the National Action Party (PAN, by its Spanish initials) Administration in Nuevo Leon, in order to promote a deliberative democracy for building a racetrack in public lands of the Fundidora Park in Monterrey. in order to do so, the administration kept a mercantile association with businessmen, and did not share information with the civil society organizations, particularly with the Comite Pro Rescate Fundidora, which questioned the legal foundation, the legitimacy, and the environmental sustainability of this public decision. Besides, the administration legally ignored the citizens, who organized themselves for obtaining the information that allows them to know the grounds of this project. This disables the construction of a public deliberative sphere, like one of the needed conditions for generating the democratic governance.
