Abstract: The State´s obligation to provide se curity for the governed is a fundamental piece within the principles of a democratic state of law, which must attend a strict respect for the fundamental rights of those who should be the main object of its protection, and implies the design of a rights- based criminal policy adopt ed by the constitutional reforms of 2008 and 2011. Furthermore, only authorized authori ties may participate in public security, which means that only the ones that have the power to intervene, by the operation of law, can do it because otherwise it could cause violations to the legal sphere of the governed.
