During 1999, Hugo Chavez president of Venezuela, carried out some actions that make illegitimate his current government. Author points out that Chavez used referendum to approved two unconstitutional laws, (Edict No. 3 and Elecioral Rules), in order to prepare the ground to a National Constitutional Assembly. In Rule Two of the Elecioral Rules vote was restricted to take advantage in elections using the electoral strategy known as "Kinos". The result was an electoral fraud and the election of a National Constitutional Assembly lacking of legitimacy. In conclusion, if the National Constitutional Assembly and the 1999 Constitution lacked of origin legitimacy, the second government of Hugo Chavez is illegitimate.
