This article analyzes the right to marry in the context of immigration. It demonstrates the ideological differences that may exist within sending and receiving countries in conceptualization of the marital institution. The article focuses on the experience of Islamic migrants in Spain. A particularly difficult issue to resolve is polygamy, an institution common in Islamic countries, which has posed a variety of problems, especially from a legal point of view. The solution arrived at in Spain comes from the legal process, and it takes as its point of reference two court cases: the Diop case, in which a Senegalese immigrant died, leaving two widows; and a case in which a Moroccan worker, who had been married simultaneously to two women, died after having divorced one of them.
