Despite the fact that the fight against the so-called clandestine immigration is one of the priority principles of the european policy on immigration, the unauthorized migration flows have continued to increase in recent years in countries like Spain. The factors that must be taken into account when searching for explanations and alternatives to this phenomenon are numerous, one of which is situated in the legal field. Considering the Spanish case as a benchmark, this paper tries to point out the deficiency of the legal measures that have been taken so far to face the issue of irregular immigration. These questions demonstrate the need of a thorough review of the mechanisms that currently constitute the legal answer to irregularity, giving priority, as this article suggests, to flexible channels which allow human mobility in the shape of economic migration.
