In this article, the author studies the different procedures to amend the constitutive pact of different confederations and federations that have existed, as a fundamental element to define the identity and nature of this kind of political configurations. Moreover, the author examines and explains the basic principles of the procedure to modify constitutive Treaties of the Communities and the European Union, as well as the problems that derive from this mechanism; further, the article examines other proposals that have been considered in the history of the European integrating process. Finally, the author studies some relevant aspects relative to the Project of the Treaty that creates a Constitution for Europe.
