In this essay, the author considers the superior interest of the child as the core of principle of her analysis, assuming that the family and its transformations imply changes at the level of family law. Thus, this branch of the law has to be adapted to the changing, circumstances of human coexistence, the aim being to provide legal security and protection to all the members of families, but mostly to children. A relevant subject related to those changes is the one that has to do with the rules on guardianship and custody of minors on behalf oftheir parents in cases ofdivorce. This subject is analyzed in the present essay, through a multidisciplinarily and comparative law perspective.
