Form the angle of civil and arbitration law, this essay analyzes the requirement of form of the arbitration agreement, particularly in light of the amendments that the United Nations Commission on International Trade Law has recently debated and approved on the matter. To gauge its importance the origins of the current rule are commented and how business reality surpassed the same. Its impact on the arbitration regime is then dealt with before finalizing with an applauding conclusion and suggestion that the Mexican legislature adopt the same.
