The article intends to analyze the different groups of persons who have legal capacity to bring actions for violation of a trade mark in Spain. Specifically the proprietor of a trade mark, the licensees, the usufructuaries, the joint tenants of a trade mark and the consumers' unions. The article ends with the study of the capacity to bring action for damages of the applicant of a trade mark.
