Since the notion of the separation of powers is structured the legislature stands defiant against the judiciary; however, the revitalization of the Constitutions made Judges are not subject to the law but to control the legislative activity. Produced the struggle between the two organs of power to be the “last” interpreter of the Constitution because it allows the domination of another organ of power, the present paper attempts to show how the two bodies are in a historical context that will contribute to determine ultimately the scope of its powers.
