This article analyzes the convergence of the common law and civil law systems in relation to the parameters of judicial review, particularly when constitutional principles, both explicit and implicit, work to invalidate ordinary laws. The article also uses the Canadian experience to examine how unwritten but implicit constitutional principles can be used for the purposes of judicial review. It also reviews the theory of The Invisible Constitution, by Laurence H. Tribe. Finally, we face the question of the living Constitution, which includes the concept of the Constitution as a living instrument beyond its formal text.
