Industrial capitalism was characterized by the existence of a disciplinary society, which has now been replaced by the control society. The same is related to information-technology through which space, time and movements of employees are monitored to generate their self-control and thus achieve greater performance and productivity in their workday.

In this work, the object of analysis is specified exclusively in the study of labor relations generated in the private sector, excluding labor relations in the government. The method used is based on the documentary investigation of a deductive and interpretative nature of the Mexican positive legal regulations.

The Objective is to analyze the considerations of the rights of the employer with respect to the surveillance and control exercised by the employer over the worker against the counterweight of the nonspecific Fundamental Rights of the employer, such as the right to privacy.
