CRUZ RUEDA, Elisa; MESRI HASHEMI-DILMAGHANI, Parastoo Anita  e  SAM BAUTISTA, María Magdalena. Indigenous Peoples Right to Consultation vs. the Government: The Nahua Community of San Felipe Cuauhtenco, Municipality of Contla de Juan Cuamatzi, Tlaxcala, Mexico. Rev. pueblos front. digit. This paper describes the process that a group of Nahua and similar communities from Tlaxcala demand regarding their right to name their authorities through community normative systems (the indigenous electoral law). The fight in the courts was led by San Felipe Cuauhtenco and sought to demand respect for the collective rights of the ninety-four communities in Tlaxcala that appoint their authorities applying their own legal systems, the right to autonomy, and to prior consultation. The data was generated from field work, applying a participatory observation methodology, and a coordinated exercise of support for the movement, an example of applied legal anthropology. It concluded that the Mexican State supplants the self-determination of the original peoples through the implementation of supposed consultations.

Palavras-chave : right to consultation; indigenous peoples; autonomy; self-determination.
