A statement released by the Office of the Prosecutor of the International Criminal Court on September 2016 (entitled Policy Paper on Case Selection and Prioritisation) claims that it would prioritize the prosecution of crimes that are committed by means of, or that result in, inter alia, the destruction of the environment, the illegal exploitation of natural resources or the illegal dispossession of land. This statement was understood as a shift in the Court’s remit, and that it would now prosecute environmental crimes. In this essay, the real impact of the policy paper will be analyzed, taking in consideration the context in which it was released. It will evaluate if the ICC could prosecute environmental crimes under the current legal framework. Lastly, an analysis of the four core crimes of the Rome Statute will be made to assess if they can be committed in a way that involves environmental damage.
