The paper analyze the Chilean Constitutional Court´s decision that upheld the constitutionality of the Civil Code´s articles which restrict the right of same sex couples to marriage, from the scope of the constitutional argumentation. The theoretical framework on fundamental rights developed by J. Sieckmann is applied in order to show the collision of the argumental lines deployed by the court with the constitutional principles of autonomy, equality and dignity.
