GARCIA-CASTILLO, Zoraida et al. Technical and Rational Elements for the Assessment of Scientific Evidence Reliability: Reference on Three Forensic Science Areas. Isonomía [online]. 2020, n.53, pp.31-69. Epub 09-Jun-2021. ISSN 1405-0218.
The adoption of the accusatory criminal system in many Latin American countries has faced many challenges, among them that of configuring new standards for judicial action. This article focuses on the challenge faced by judges when tasked with assessing scientific evidence reliability, since its nature lies beyond the expertise of most judges. Evaluating the reliability and correctness of individual evidence so as to allocate a specific weight to it in the whole of the evidence is a task in which judges require multidisciplinary analyses. We propose both general and specific guidelines for assessing the reliability of the evidence from three forensic areas (genetics, fingerprint and forensic voice comparison) as an innovative tool in the Latin American judicial environment.
