The situation of human rights concerning indigenous peoples and minorities in Mexico has been extremely precarious. The right to a cultural identity is a fundamental right that until today has lacked appropriate enforcement, even with the support of international organisms, declarations and conventions. The author makes clear emphasis in the necessity of an appropriate binding regulation, arguing that the enunciation of rights contained in the American Convention of Human rights is insufficient. Until today, the only binding instrument turns out to be the Agreement 169 of the ILO with respect to the indigenous peoples and some Declarations which refer to national minorities and their members, situation that should be modified in the future.
