This article examines the current configuration of the right to elementary education in Brazil and its historical changes. The situation in effect is described as a legally protected right that citizens can demand through the court system because of the indispensable nature of education. Our constitution defines the state as the subject of duty of this social benefit, in relation to the object, which is the right to education. The state must make school universal for all and serve citizens in their totality, in order to meet the objectives of democracy. The financing for such protection is stipulated in the constitution of a federative nation. But reality has not always corresponded to the progress made in legal texts; the nation's debt to the school-age population is still sizable in comparison with the challenge of quality.
